1. WHO THESE TERMS APPLY TO
These Terms and Conditions govern the relationship between Sailing Alisios ("we," "us," "our") and any person ("you," "the participant") who makes an enquiry, booking, or payment for any trip, voyage, or experience offered by Sailing Alisios.
By submitting an enquiry form, paying a deposit, or joining any Sailing Alisios trip, you confirm that you have read, understood, and agreed to these Terms and Conditions in full.

2. BOOKINGS AND DEPOSITS
2.1 All bookings are subject to availability and are not confirmed until we have received your completed enquiry, communicated availability, and received payment of the required deposit.
2.2 A deposit of 50% of the total trip cost is required to confirm your place on board. Your place is not secured until this deposit is received.
2.3 The remaining balance is due one month before the departure date.
2.4 Payments may be made by bank transfer or WISE transfer. All payments are processed securely. We do not store full card details.
2.5 By paying your deposit, you confirm that you are 18 years of age or older and that all information you have provided is accurate and complete.
3. CANCELLATION BY YOU
3.1 All cancellation requests must be made in writing to info@sailingalisios.com or to +34 630 24 82 11.
3.2 The following cancellation policy applies:
Cancellation more than 30 days before departure: full refund of all payments made
Cancellation 30 days or fewer before departure: the deposit (50% of the total trip cost) is non-refundable. By this point your place has been reserved and the trip has been planned around your participation.
3.3 The remaining balance (if already paid) will be refunded in full for cancellations made more than 30 days before departure.
3.4 We strongly recommend that all participants purchase comprehensive travel insurance that includes cancellation cover. Sailing Alisios accepts no liability for costs arising from your cancellation.
4. CANCELLATION OR MODIFICATION BY SAILING ALISIOS
4.1 We reserve the right to cancel or modify any trip in the following circumstances:
Insufficient bookings to operate the trip safely and viably
Weather conditions or sea state that, in the captain's professional judgement, make sailing unsafe
Mechanical failure or vessel unavailability
Any circumstance beyond our reasonable control (see Section 9, Force Majeure)
4.2 In the event that we cancel a trip before departure, you will receive a full refund of all payments made, or the option to transfer your booking to another available date.
4.3 We will notify you of any cancellation as early as practically possible.
4.4 Beyond the refund described in 4.2, Sailing Alisios accepts no further liability for costs arising from our cancellation — including flights, accommodation, transfers, or other expenses you may have incurred. This is why we recommend comprehensive travel insurance.
4.5 The captain's decision regarding safe sailing conditions is final. Decisions made on safety grounds do not constitute a breach of contract.
5. CHANGES TO ITINERARY
5.1 All routes, anchorages, and port stops are indicative only. Sailing Alisios explicitly does not guarantee any fixed itinerary.
5.2 Routes are determined by weather, wind conditions, sea state, and the captain's professional judgement. These may change at any time, including during the trip itself.
5.3 Changes to itinerary made for reasons of safety or weather do not constitute a breach of contract and do not entitle participants to a refund or compensation.
5.4 This flexibility is fundamental to the nature of sailing and is clearly communicated as part of our offering. By booking, you confirm you understand and accept this.
6. PARTICIPANT RESPONSIBILITIES
6.1 You are responsible for ensuring that you are in adequate physical health to participate in a sailing trip. If you have any medical conditions, physical limitations, or concerns, you must disclose these to us in writing before your booking is confirmed.
6.2 You are responsible for ensuring that you hold valid travel documents — including passports, visas, and any other documentation required for the countries visited — throughout the trip.
6.3 You are responsible for your own personal property at all times. Sailing Alisios accepts no liability for loss, theft, or damage to personal belongings.
6.4 All participants must follow the safety instructions of the captain and crew at all times. The captain has ultimate authority on board and their decisions regarding safety, routing, and vessel management are final.
6.5 Behaviour that endangers the safety of other crew members, damages the vessel, or disrupts the trip may result in removal from the trip without refund.
6.6 Participants are expected to treat fellow crew members and Sailing Alisios staff with respect. We reserve the right to remove any participant whose behaviour is deemed unacceptable, without refund.
7. WHAT IS INCLUDED AND EXCLUDED
7.1 The inclusions and exclusions for each trip are detailed on the relevant trip page of our website, and forms part of your contract with us.
7.2 Inclusions vary by trip. Unless explicitly stated in your booking confirmation, the following are not included in the trip price: flights, airport transfers, alcohol, personal spending money, and travel insurance.
7.3 Sailing Alisios is not responsible for any costs you incur outside of the stated inclusions.
8. LIABILITY AND LIMITATION OF LIABILITY
8.1 Sailing Alisios operates professionally crewed sailing voyages in open water. By booking, you acknowledge that sailing involves inherent risks including, but not limited to: adverse weather conditions, rough seas, physical exertion, seasickness, falling on deck, and other risks associated with maritime activity.
8.2 Sailing Alisios takes all reasonable steps to ensure participant safety, including maintaining properly certified vessels, employing qualified and experienced skippers, conducting safety briefings, and carrying appropriate safety equipment.
8.3 To the maximum extent permitted by Spanish and applicable EU law, Sailing Alisios's liability to you is limited to the total amount paid by you for your trip.
8.4 Sailing Alisios accepts no liability for:
Personal injury, illness, or death arising from circumstances outside our reasonable control
Loss or damage to personal property
Costs arising from changes to itinerary made for reasons of safety or weather
Costs arising from flight delays, cancellations, or missed connections
Acts or omissions of third-party suppliers
8.5 Nothing in these Terms limits our liability for death or personal injury caused by our own negligence, or for any liability that cannot be excluded under applicable law.
9. FORCE MAJEURE
9.1 Sailing Alisios shall not be liable for any failure or delay in performing our obligations where such failure or delay results from circumstances beyond our reasonable control, including but not limited to: extreme weather events, natural disasters, acts of government or authority, port closures, strikes, pandemics, or civil unrest.
9.2 In the event of a force majeure cancellation, we will offer either a full refund of payments made or the option to transfer to an alternative date. No further compensation will be payable.
10. TRAVEL INSURANCE
10.1 Comprehensive travel insurance is recommended for all Sailing Alisios participants. We recommend that it includes at minimum: trip cancellation, medical expenses (including emergency evacuation by sea or air), and personal liability.
10.2 We recommend that your policy specifically covers sailing and maritime activities. Standard travel insurance policies sometimes exclude these — check your policy carefully.
11. COMPLAINTS
11.1 If you have a complaint during your trip, please raise it with the captain or a Sailing Alisios representative as soon as possible. Most issues can be resolved on board when raised promptly.
11.2 If your complaint is not resolved to your satisfaction during the trip, submit it to us in writing within 28 days of your return, at info@sailingalisios.com. We will respond within 14 days.
11.3 We are committed to handling complaints fairly and promptly.
12. PHOTOGRAPHS AND MARKETING
12.1 Sailing Alisios may take photographs and video footage during trips for use in marketing materials, on our website, and on social media.
12.2 If you do not wish to appear in such materials, please inform us in writing before your trip begins. We will make reasonable efforts to accommodate your request.
12.3 By not objecting, you grant Sailing Alisios a non-exclusive, royalty-free licence to use images in which you appear for promotional purposes.
13. GOVERNING LAW AND DISPUTES
13.1 These Terms and Conditions are governed by the laws of Spain.
13.2 Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the Spanish courts.
13.3 We will always attempt to resolve disputes amicably before any formal proceedings are initiated.
14. CHANGES TO THESE TERMS
14.1 We reserve the right to update these Terms and Conditions at any time. The version in effect at the time of your booking confirmation governs your trip.
14.2 The date at the top of this page reflects the most recent update.
